Anyway, I'd be awfully curious to know exactly which rights-holders have allowed this. I've talked to my publisher in the past about fanfic, and their official line is to discourage it. Since DAW is a subsidiary of Penguin, and Penguin is listed as one of the "partners" on the Fanlib site, I find myself feeling a bit skeptical about their claims.

And so far, I'm not aware of a single author who has been contacted by their publisher with a request to release the rights for a project like this. It's possible this has happened and I just haven't heard about it, but the whole thing makes me wince.

Not that it's likely to affect me personally. Somehow I don't see goblin fanfic catching on any time soon ;-)

*wry* That is one of the many questions that the Fanlib board has sidestepped and done its best to to answer. Myself, I'm coming more and more to the conclusion that this is a genuine scam with malice aforethought, and that they know perfectly well what they're doing, writing their TOS so stringently and their FAQ so vaguely. As far as I can glean, the permissions of the "partners" are extremely limited in nature, and apply only to specific sponsored contests. Which they would then have the right cherry-pick for the best stories for their own use, without compensation to the fic authors.

And while I can see Simon and Schuster maybe doing that, I have a really hard time imagining DAW being part to such a thing. Which just makes me wonder all the more about how much Fanlib is lying to us all.

I see that their FAQ is still offline for revisions...

Heck, even their screencap pics are a potential copyright problem. Do they have permission from Tolkien's publisher to post LotR fanfic? And permission from the film companies to post the pics? If you're going to boast about your partners giving you permission, then either you have to limit what you do to that very narrow group where you have permission, or you need to acknowledge that the vast majority of what you're posting doesn't have any legal protection or permission whatsoever.

My guess is that it's going to explode big. How much of the resulting debris will be public I couldn't say.

Yeah, I really don't think Tolkein's publisher or estate gave permission for all that fic. Nor Rowling for the Adult HP fic, since she's on record against that.

Ah, I found the quote from their brochure for the publishers et al.

What this actually means for the current site content is anyone's guess.

I've been following but not in detail (it's always looked like a stupid idea to me). Tammy was posting about this yesterday and included the quote from one of the pages discussing it: "Typical men. They see a group of self-governing women and want to wade in, wag their dicks about, and announce they are here to take care of all the ladies."

Though, honestly, the more I follow this, the more I think it's a real scam and they know it. And are upset because we spotted it instantly. Those mean, nasty fans, refusing to be bilked!

*considers* Well, the CEO seems to have gotten an account, mimbo I believe. But no entries yet. FanLib.com does have forums, though, I believe, which should provide /lots/ of opportunity.

... holy crap, I was right the first time. They're a vanity-press scam! They're the Publish America of fanfic! This is /exactly/ how self-publishing scams work.

And frankly, I totally believe the bit about deliberately 'harnessing' fan labor as unpaid labor. There's a Bussiness Week article in which the author talks about how clever it is of Fanlib to have done just that.
