The height rule really came out of doujinshi, and isn't nearly as hard-and-fast on this side of the water, now that the fan-base has expanded so much. On top of that, tenipuri is (or, at least, started as) a shounen manga, and a lot of shounen authors tend to make a lot of their more dominant characters shorter; sometimes I really think they do it on purpose, just to make life interesting for the fans who try to abide by the height rule.
For myself, I tend to ignore height completely, and go by who seems like the more aggressive or domineering character. I'm also very fond of reversibles. For these two, I would expect Shishido to be the one on top more frequently, because Ohtori seems prone to following his lead. I doubt it would be an exclusive thing, though.
